社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)經(jing)濟體(ti)制(zhi)(zhi)(zhi)是(shi)中(zhong)(zhong)國(guo)(guo)特色(se)社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)的(de)(de)重(zhong)大(da)(da)(da)理論和實(shi)踐創(chuang)新(xin),是(shi)社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)基本(ben)經(jing)濟制(zhi)(zhi)(zhi)度的(de)(de)重(zhong)要(yao)(yao)(yao)組(zu)成(cheng)部分。改(gai)(gai)革(ge)開放(fang)(fang)特別是(shi)黨(dang)的(de)(de)十八大(da)(da)(da)以來,我國(guo)(guo)堅持(chi)全面深(shen)化(hua)改(gai)(gai)革(ge),充分發揮經(jing)濟體(ti)制(zhi)(zhi)(zhi)改(gai)(gai)革(ge)的(de)(de)牽引作用,不(bu)(bu)(bu)(bu)斷完(wan)善(shan)社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)經(jing)濟體(ti)制(zhi)(zhi)(zhi),極大(da)(da)(da)調(diao)動(dong)了億萬人民的(de)(de)積極性(xing),極大(da)(da)(da)促(cu)進了生產力發展(zhan),極大(da)(da)(da)增(zeng)強了黨(dang)和國(guo)(guo)家的(de)(de)生機活力,創(chuang)造了世所罕見(jian)的(de)(de)經(jing)濟快速(su)發展(zhan)奇跡。同時要(yao)(yao)(yao)看到,中(zhong)(zhong)國(guo)(guo)特色(se)社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)進入(ru)新(xin)時代,社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)要(yao)(yao)(yao)矛盾發生變化(hua),經(jing)濟已由高(gao)(gao)(gao)速(su)增(zeng)長階段轉(zhuan)向高(gao)(gao)(gao)質(zhi)量發展(zhan)階段,與(yu)這些新(xin)形(xing)勢新(xin)要(yao)(yao)(yao)求相比,我國(guo)(guo)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)體(ti)系(xi)還(huan)(huan)不(bu)(bu)(bu)(bu)健全、市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)發育還(huan)(huan)不(bu)(bu)(bu)(bu)充分,政府和市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)的(de)(de)關系(xi)沒(mei)有完(wan)全理順,還(huan)(huan)存在(zai)(zai)(zai)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)激勵不(bu)(bu)(bu)(bu)足、要(yao)(yao)(yao)素流動(dong)不(bu)(bu)(bu)(bu)暢、資源配置效率不(bu)(bu)(bu)(bu)高(gao)(gao)(gao)、微觀經(jing)濟活力不(bu)(bu)(bu)(bu)強等問題(ti),推(tui)動(dong)高(gao)(gao)(gao)質(zhi)量發展(zhan)仍存在(zai)(zai)(zai)不(bu)(bu)(bu)(bu)少體(ti)制(zhi)(zhi)(zhi)機制(zhi)(zhi)(zhi)障礙,必須進一步解放(fang)(fang)思想,堅定不(bu)(bu)(bu)(bu)移深(shen)化(hua)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)化(hua)改(gai)(gai)革(ge),擴大(da)(da)(da)高(gao)(gao)(gao)水平開放(fang)(fang),不(bu)(bu)(bu)(bu)斷在(zai)(zai)(zai)經(jing)濟體(ti)制(zhi)(zhi)(zhi)關鍵性(xing)基礎性(xing)重(zhong)大(da)(da)(da)改(gai)(gai)革(ge)上突(tu)破創(chuang)新(xin)。為貫徹(che)落實(shi)黨(dang)的(de)(de)十九大(da)(da)(da)和十九屆四中(zhong)(zhong)全會(hui)(hui)關于堅持(chi)和完(wan)善(shan)社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)基本(ben)經(jing)濟制(zhi)(zhi)(zhi)度的(de)(de)戰略部署(shu),在(zai)(zai)(zai)更高(gao)(gao)(gao)起點、更高(gao)(gao)(gao)層次、更高(gao)(gao)(gao)目(mu)標上推(tui)進經(jing)濟體(ti)制(zhi)(zhi)(zhi)改(gai)(gai)革(ge)及其他各(ge)方面體(ti)制(zhi)(zhi)(zhi)改(gai)(gai)革(ge),構建更加系(xi)統完(wan)備、更加成(cheng)熟定型的(de)(de)高(gao)(gao)(gao)水平社(she)(she)(she)會(hui)(hui)主(zhu)(zhu)(zhu)義(yi)(yi)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)經(jing)濟體(ti)制(zhi)(zhi)(zhi),現提出如下(xia)意見(jian)。

一、總體要求

(一)指導思想。以習近平新(xin)時代中(zhong)國特色(se)社(she)會主義(yi)思想為(wei)指導,全(quan)面貫徹黨的(de)十九(jiu)大和十九(jiu)屆二中(zhong)、三(san)中(zhong)、四(si)(si)中(zhong)全(quan)會精(jing)神,堅(jian)決貫徹黨的(de)基(ji)本(ben)理論、基(ji)本(ben)路線、基(ji)本(ben)方略(lve),統籌推進(jin)“五(wu)位一體(ti)”總體(ti)布(bu)局(ju)和協調(diao)推進(jin)“四(si)(si)個全(quan)面”戰略(lve)布(bu)局(ju),堅(jian)持(chi)穩(wen)中(zhong)求進(jin)工作總基(ji)調(diao),堅(jian)持(chi)新(xin)發展理念,堅(jian)持(chi)以供(gong)給側結(jie)構性改革為(wei)主線,堅(jian)持(chi)以人民為(wei)中(zhong)心(xin)的(de)發展思想,堅(jian)持(chi)和完善社(she)會主義(yi)基(ji)本(ben)經(jing)(jing)濟(ji)(ji)制(zhi)度(du)(du),以完善產權(quan)制(zhi)度(du)(du)和要素市(shi)場化配置(zhi)為(wei)重點(dian),全(quan)面深(shen)化經(jing)(jing)濟(ji)(ji)體(ti)制(zhi)改革,加快完善社(she)會主義(yi)市(shi)場經(jing)(jing)濟(ji)(ji)體(ti)制(zhi),建設高(gao)標準市(shi)場體(ti)系(xi)(xi),實(shi)現(xian)產權(quan)有(you)效(xiao)激勵(li)、要素自由流動、價格反應靈活、競爭(zheng)公(gong)平有(you)序、企業(ye)優勝劣汰,加強和改善制(zhi)度(du)(du)供(gong)給,推進(jin)國家治(zhi)理體(ti)系(xi)(xi)和治(zhi)理能(neng)力(li)(li)現(xian)代化,推動生(sheng)產關系(xi)(xi)同(tong)(tong)生(sheng)產力(li)(li)、上(shang)層建筑同(tong)(tong)經(jing)(jing)濟(ji)(ji)基(ji)礎(chu)相(xiang)適應,促進(jin)更(geng)(geng)高(gao)質量、更(geng)(geng)有(you)效(xiao)率、更(geng)(geng)加公(gong)平、更(geng)(geng)可持(chi)續(xu)的(de)發展。

(二)基本原則

——堅(jian)持(chi)(chi)(chi)以(yi)習(xi)近平新時代中(zhong)國特(te)色社會主(zhu)(zhu)義經濟思想為指導。堅(jian)持(chi)(chi)(chi)和(he)加強(qiang)黨的全(quan)面領導,堅(jian)持(chi)(chi)(chi)和(he)完善(shan)中(zhong)國特(te)色社會主(zhu)(zhu)義制(zhi)度,強(qiang)化問題導向,把握正確改革策略(lve)和(he)方法,持(chi)(chi)(chi)續優化經濟治理方式(shi),著力(li)構(gou)建市場機制(zhi)有效、微觀主(zhu)(zhu)體(ti)有活(huo)力(li)、宏觀調控有度的經濟體(ti)制(zhi),使中(zhong)國特(te)色社會主(zhu)(zhu)義制(zhi)度更加鞏固、優越性充(chong)分體(ti)現。

——堅持解(jie)放和發(fa)展(zhan)生產力(li)。牢(lao)牢(lao)把握社會主義初級階段這個基本國情,牢(lao)牢(lao)扭(niu)住經濟建設這個中心,發(fa)揮(hui)經濟體制改革牽引作(zuo)用,協同推進政治、文化、社會、生態(tai)文明等領(ling)域改革,促進改革發(fa)展(zhan)高效聯動,進一步解(jie)放和發(fa)展(zhan)社會生產力(li),不(bu)斷滿足人(ren)民(min)日益增長的美好生活(huo)需要。

——堅持(chi)和完(wan)善(shan)社(she)(she)會(hui)主義(yi)基(ji)本經(jing)濟(ji)(ji)制(zhi)度(du)(du)。堅持(chi)和完(wan)善(shan)公有(you)制(zhi)為(wei)主體(ti)(ti)、多種(zhong)所有(you)制(zhi)經(jing)濟(ji)(ji)共同發(fa)展,按勞分配(pei)為(wei)主體(ti)(ti)、多種(zhong)分配(pei)方式(shi)并(bing)存,社(she)(she)會(hui)主義(yi)市場(chang)經(jing)濟(ji)(ji)體(ti)(ti)制(zhi)等社(she)(she)會(hui)主義(yi)基(ji)本經(jing)濟(ji)(ji)制(zhi)度(du)(du),把中國特色社(she)(she)會(hui)主義(yi)制(zhi)度(du)(du)與市場(chang)經(jing)濟(ji)(ji)有(you)機(ji)結合起來,為(wei)推動(dong)高質量(liang)發(fa)展、建設現代(dai)化經(jing)濟(ji)(ji)體(ti)(ti)系(xi)提供重(zhong)要(yao)制(zhi)度(du)(du)保障。

——堅持正確處理政府和(he)市(shi)(shi)場(chang)關系。堅持社會主義(yi)市(shi)(shi)場(chang)經(jing)濟(ji)改革方(fang)向,更加(jia)尊重(zhong)市(shi)(shi)場(chang)經(jing)濟(ji)一般規律,最大限度減少政府對市(shi)(shi)場(chang)資源的直(zhi)(zhi)接配置和(he)對微觀經(jing)濟(ji)活動(dong)的直(zhi)(zhi)接干預,充分(fen)發揮市(shi)(shi)場(chang)在資源配置中的決定性作用,更好發揮政府作用,有效彌補市(shi)(shi)場(chang)失靈。

——堅(jian)持以供給側結(jie)構性改革為主線。更多采(cai)用改革的辦法,更多運用市場(chang)化(hua)(hua)法治化(hua)(hua)手(shou)段,在鞏固(gu)、增(zeng)強(qiang)、提(ti)升、暢通上(shang)下功夫,加大(da)結(jie)構性改革力(li)度,創新制度供給,不斷增(zeng)強(qiang)經濟創新力(li)和競爭力(li),適應和引發(fa)有效需(xu)(xu)求,促進更高水(shui)平的供需(xu)(xu)動態平衡(heng)。

——堅持(chi)擴(kuo)大高(gao)水(shui)平(ping)開(kai)(kai)放(fang)和(he)(he)深化(hua)市(shi)場化(hua)改革互促(cu)共進(jin)。堅定不移擴(kuo)大開(kai)(kai)放(fang),推動由(you)商品和(he)(he)要素流動型開(kai)(kai)放(fang)向規(gui)則(ze)等制度(du)型開(kai)(kai)放(fang)轉變,吸收(shou)借鑒國際(ji)成熟(shu)市(shi)場經濟制度(du)經驗和(he)(he)人類文明有益成果(guo),加快國內制度(du)規(gui)則(ze)與(yu)國際(ji)接軌(gui),以高(gao)水(shui)平(ping)開(kai)(kai)放(fang)促(cu)進(jin)深層次(ci)市(shi)場化(hua)改革。

 

二、堅持公(gong)有制為(wei)主體(ti)、多(duo)種所有制經濟共同(tong)發展,增強微觀主體(ti)活(huo)力

毫不(bu)動搖鞏固和發(fa)展公(gong)有制(zhi)經濟,毫不(bu)動搖鼓勵(li)、支(zhi)持、引(yin)導非公(gong)有制(zhi)經濟發(fa)展,探索公(gong)有制(zhi)多種(zhong)實現形式,支(zhi)持民營(ying)企業改革發(fa)展,培育更多充(chong)滿活力(li)的市場主體。

(一)推(tui)進(jin)國(guo)(guo)(guo)有(you)(you)(you)經濟布局優(you)(you)化(hua)和結構調整。堅(jian)持(chi)有(you)(you)(you)進(jin)有(you)(you)(you)退、有(you)(you)(you)所(suo)為(wei)(wei)有(you)(you)(you)所(suo)不為(wei)(wei),推(tui)動國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben)更多投(tou)向關系(xi)國(guo)(guo)(guo)計民生的(de)重(zhong)要領(ling)域(yu)(yu)和關系(xi)國(guo)(guo)(guo)家(jia)經濟命脈、科技、國(guo)(guo)(guo)防、安全等領(ling)域(yu)(yu),服務國(guo)(guo)(guo)家(jia)戰略目標,增強國(guo)(guo)(guo)有(you)(you)(you)經濟競爭力、創新(xin)力、控制(zhi)力、影響力、抗風險能(neng)力,做(zuo)強做(zuo)優(you)(you)做(zuo)大國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben),有(you)(you)(you)效防止國(guo)(guo)(guo)有(you)(you)(you)資(zi)產(chan)(chan)流失。對處于充分競爭領(ling)域(yu)(yu)的(de)國(guo)(guo)(guo)有(you)(you)(you)經濟,通過資(zi)本(ben)化(hua)、證(zheng)券化(hua)等方式優(you)(you)化(hua)國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben)配(pei)置,提高國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben)收益(yi)。進(jin)一步完善(shan)和加強國(guo)(guo)(guo)有(you)(you)(you)資(zi)產(chan)(chan)監管,有(you)(you)(you)效發揮(hui)國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben)投(tou)資(zi)、運營(ying)公司功能(neng)作用(yong),堅(jian)持(chi)一企一策(ce),成熟一個推(tui)動一個,運行一個成功一個,盤活存量國(guo)(guo)(guo)有(you)(you)(you)資(zi)本(ben),促進(jin)國(guo)(guo)(guo)有(you)(you)(you)資(zi)產(chan)(chan)保值(zhi)增值(zhi)。

(二)積極穩(wen)妥推(tui)(tui)進(jin)(jin)國(guo)有(you)(you)企(qi)(qi)業(ye)(ye)(ye)(ye)混合(he)(he)(he)所有(you)(you)制(zhi)改(gai)革。在深入開(kai)展重點領(ling)(ling)域(yu)(yu)混合(he)(he)(he)所有(you)(you)制(zhi)改(gai)革試點基礎上,按(an)照完善治理(li)(li)、強化(hua)(hua)激勵、突出(chu)主業(ye)(ye)(ye)(ye)、提高效率要求,推(tui)(tui)進(jin)(jin)混合(he)(he)(he)所有(you)(you)制(zhi)改(gai)革,規(gui)范有(you)(you)序發展混合(he)(he)(he)所有(you)(you)制(zhi)經(jing)濟。對充分競爭領(ling)(ling)域(yu)(yu)的(de)國(guo)家(jia)出(chu)資(zi)(zi)企(qi)(qi)業(ye)(ye)(ye)(ye)和(he)國(guo)有(you)(you)資(zi)(zi)本運營(ying)公(gong)司出(chu)資(zi)(zi)企(qi)(qi)業(ye)(ye)(ye)(ye),探索(suo)將部分國(guo)有(you)(you)股(gu)權轉化(hua)(hua)為優先股(gu),強化(hua)(hua)國(guo)有(you)(you)資(zi)(zi)本收益功(gong)能。支持符合(he)(he)(he)條件的(de)混合(he)(he)(he)所有(you)(you)制(zhi)企(qi)(qi)業(ye)(ye)(ye)(ye)建立骨干員工持股(gu)、上市(shi)公(gong)司股(gu)權激勵、科技型企(qi)(qi)業(ye)(ye)(ye)(ye)股(gu)權和(he)分紅(hong)激勵等(deng)中長期激勵機(ji)制(zhi)。深化(hua)(hua)國(guo)有(you)(you)企(qi)(qi)業(ye)(ye)(ye)(ye)改(gai)革,加快完善國(guo)有(you)(you)企(qi)(qi)業(ye)(ye)(ye)(ye)法人治理(li)(li)結構和(he)市(shi)場(chang)化(hua)(hua)經(jing)營(ying)機(ji)制(zhi),健(jian)全經(jing)理(li)(li)層任期制(zhi)和(he)契約化(hua)(hua)管(guan)理(li)(li),完善中國(guo)特色(se)現代企(qi)(qi)業(ye)(ye)(ye)(ye)制(zhi)度(du)。對混合(he)(he)(he)所有(you)(you)制(zhi)企(qi)(qi)業(ye)(ye)(ye)(ye),探索(suo)建立有(you)(you)別于國(guo)有(you)(you)獨資(zi)(zi)、全資(zi)(zi)公(gong)司的(de)治理(li)(li)機(ji)制(zhi)和(he)監(jian)(jian)管(guan)制(zhi)度(du)。對國(guo)有(you)(you)資(zi)(zi)本不再絕對控股(gu)的(de)混合(he)(he)(he)所有(you)(you)制(zhi)企(qi)(qi)業(ye)(ye)(ye)(ye),探索(suo)實施更加靈活高效的(de)監(jian)(jian)管(guan)制(zhi)度(du)。

(三(san))穩(wen)步(bu)推進(jin)自(zi)(zi)然壟斷(duan)行(xing)業(ye)(ye)改(gai)革。深化以(yi)政(zheng)(zheng)(zheng)企分開、政(zheng)(zheng)(zheng)資分開、特(te)許經(jing)營、政(zheng)(zheng)(zheng)府(fu)監管為主(zhu)要(yao)內容的(de)改(gai)革,提高自(zi)(zi)然壟斷(duan)行(xing)業(ye)(ye)基(ji)礎設(she)施(shi)供(gong)給質量,嚴(yan)格監管自(zi)(zi)然壟斷(duan)環節(jie),加快實現競爭(zheng)(zheng)性(xing)(xing)環節(jie)市(shi)(shi)(shi)場(chang)(chang)化,切(qie)實打破行(xing)政(zheng)(zheng)(zheng)性(xing)(xing)壟斷(duan),防止市(shi)(shi)(shi)場(chang)(chang)壟斷(duan)。構(gou)建(jian)有效競爭(zheng)(zheng)的(de)電(dian)(dian)力市(shi)(shi)(shi)場(chang)(chang),有序放開發用電(dian)(dian)計劃和競爭(zheng)(zheng)性(xing)(xing)環節(jie)電(dian)(dian)價,提高電(dian)(dian)力交易市(shi)(shi)(shi)場(chang)(chang)化程度(du)。推進(jin)油(you)氣(qi)管網對(dui)市(shi)(shi)(shi)場(chang)(chang)主(zhu)體公平開放,適時放開天然氣(qi)氣(qi)源(yuan)和銷售價格,健全競爭(zheng)(zheng)性(xing)(xing)油(you)氣(qi)流通(tong)市(shi)(shi)(shi)場(chang)(chang)。深化鐵路行(xing)業(ye)(ye)改(gai)革,促進(jin)鐵路運輸業(ye)(ye)務(wu)(wu)市(shi)(shi)(shi)場(chang)(chang)主(zhu)體多元化和適度(du)競爭(zheng)(zheng)。實現郵(you)政(zheng)(zheng)(zheng)普遍服務(wu)(wu)業(ye)(ye)務(wu)(wu)與競爭(zheng)(zheng)性(xing)(xing)業(ye)(ye)務(wu)(wu)分業(ye)(ye)經(jing)營。完善煙草專(zhuan)賣專(zhuan)營體制,構(gou)建(jian)適度(du)競爭(zheng)(zheng)新機制。

(三)健全(quan)國家公(gong)共衛(wei)生(sheng)(sheng)(sheng)應急管理體系。強化(hua)公(gong)共衛(wei)生(sheng)(sheng)(sheng)法(fa)(fa)治保障,完(wan)(wan)善(shan)公(gong)共衛(wei)生(sheng)(sheng)(sheng)領(ling)域(yu)相(xiang)關法(fa)(fa)律法(fa)(fa)規(gui)。把生(sheng)(sheng)(sheng)物(wu)安(an)(an)全(quan)納(na)入國家安(an)(an)全(quan)體系,系統(tong)規(gui)劃國家生(sheng)(sheng)(sheng)物(wu)安(an)(an)全(quan)風險(xian)防(fang)控和治理體系建設(she),全(quan)面提高國家生(sheng)(sheng)(sheng)物(wu)安(an)(an)全(quan)治理能(neng)(neng)力(li)。健全(quan)公(gong)共衛(wei)生(sheng)(sheng)(sheng)服務(wu)體系,優化(hua)醫療(liao)(liao)衛(wei)生(sheng)(sheng)(sheng)資源投入結構,加強農村(cun)、社區等(deng)基(ji)層(ceng)(ceng)防(fang)控能(neng)(neng)力(li)建設(she)。完(wan)(wan)善(shan)優化(hua)重(zhong)大疫情救(jiu)(jiu)治體系,建立健全(quan)分(fen)級(ji)、分(fen)層(ceng)(ceng)、分(fen)流(liu)的傳染病(bing)等(deng)重(zhong)大疫情救(jiu)(jiu)治機制。完(wan)(wan)善(shan)突發重(zhong)特大疫情防(fang)控規(gui)范和應急救(jiu)(jiu)治管理辦法(fa)(fa)。健全(quan)重(zhong)大疾(ji)病(bing)醫療(liao)(liao)保險(xian)和救(jiu)(jiu)助制度,完(wan)(wan)善(shan)應急醫療(liao)(liao)救(jiu)(jiu)助機制。探索(suo)建立特殊群(qun)體、特定疾(ji)病(bing)醫藥費(fei)豁免制度。健全(quan)統(tong)一的應急物(wu)資保障體系,優化(hua)重(zhong)要應急物(wu)資產能(neng)(neng)保障和區域(yu)布局,健全(quan)國家儲備體系,完(wan)(wan)善(shan)儲備品類、規(gui)模、結構,提升儲備效(xiao)能(neng)(neng)。

 

七、建設更(geng)高水平開(kai)放型經濟新(xin)體(ti)制,以開(kai)放促改革(ge)促發展

實(shi)行更(geng)加積極主動的(de)開放戰略,全面對接國(guo)際高標(biao)準市場規(gui)則體系,實(shi)施更(geng)大范圍、更(geng)寬領(ling)域(yu)、更(geng)深層次的(de)全面開放。

(一(yi))以“一(yi)帶一(yi)路”建(jian)(jian)設為重(zhong)點構建(jian)(jian)對外開(kai)放(fang)新格局。堅持互(hu)利共贏的(de)開(kai)放(fang)戰略(lve),推動共建(jian)(jian)“一(yi)帶一(yi)路”走深(shen)走實和高質(zhi)量發(fa)展,促進(jin)(jin)商品、資金(jin)、技術、人員(yuan)更大(da)范圍流通,依(yi)托各類開(kai)發(fa)區(qu)發(fa)展高水平經貿產業(ye)合作園(yuan)區(qu),加(jia)強(qiang)(qiang)市場、規則、標(biao)準(zhun)方面(mian)的(de)軟聯通,強(qiang)(qiang)化合作機制建(jian)(jian)設。加(jia)大(da)西部(bu)和沿邊地區(qu)開(kai)放(fang)力度,推進(jin)(jin)西部(bu)陸(lu)海新通道建(jian)(jian)設,促進(jin)(jin)東(dong)中西互(hu)動協同開(kai)放(fang),加(jia)快形成(cheng)陸(lu)海內外聯動、東(dong)西雙向互(hu)濟的(de)開(kai)放(fang)格局。

(二(er))加快自(zi)由貿(mao)易(yi)(yi)(yi)試驗區、自(zi)由貿(mao)易(yi)(yi)(yi)港等(deng)對(dui)外開放高(gao)地建(jian)設(she)。深化自(zi)由貿(mao)易(yi)(yi)(yi)試驗區改(gai)革(ge)(ge),在(zai)更(geng)大范圍復制推(tui)(tui)廣(guang)改(gai)革(ge)(ge)成果。建(jian)設(she)好中國(上海(hai))自(zi)由貿(mao)易(yi)(yi)(yi)試驗區臨港新(xin)片區,賦予其更(geng)大的自(zi)主(zhu)發(fa)展、自(zi)主(zhu)改(gai)革(ge)(ge)和(he)自(zi)主(zhu)創新(xin)管理權限。聚焦貿(mao)易(yi)(yi)(yi)投資自(zi)由化便利(li)化,穩步推(tui)(tui)進海(hai)南(nan)自(zi)由貿(mao)易(yi)(yi)(yi)港建(jian)設(she)。

(三)健全(quan)(quan)(quan)高水平(ping)開(kai)放政策保障機制(zhi)(zhi)。推(tui)進(jin)(jin)(jin)貿易(yi)高質量發展,拓展對外(wai)(wai)貿易(yi)多元化,提升(sheng)一般貿易(yi)出口(kou)產(chan)品附加值,推(tui)動加工貿易(yi)產(chan)業鏈(lian)升(sheng)級和服(fu)務(wu)貿易(yi)創新發展。辦好中國國際進(jin)(jin)(jin)口(kou)博覽會,更大(da)規模增(zeng)加商(shang)(shang)品和服(fu)務(wu)進(jin)(jin)(jin)口(kou),降低關稅(shui)總(zong)水平(ping),努力消除非關稅(shui)貿易(yi)壁壘,大(da)幅(fu)削減進(jin)(jin)(jin)出口(kou)環節制(zhi)(zhi)度(du)性成本,促(cu)進(jin)(jin)(jin)貿易(yi)平(ping)衡發展。推(tui)動制(zhi)(zhi)造業、服(fu)務(wu)業、農(nong)業擴大(da)開(kai)放,在更多領域允許外(wai)(wai)資控股(gu)或獨資經營,全(quan)(quan)(quan)面(mian)取(qu)消外(wai)(wai)資準入負(fu)面(mian)清(qing)(qing)單(dan)之外(wai)(wai)的限制(zhi)(zhi)。健全(quan)(quan)(quan)外(wai)(wai)商(shang)(shang)投資準入前國民待遇加負(fu)面(mian)清(qing)(qing)單(dan)管(guan)理制(zhi)(zhi)度(du),推(tui)動規則(ze)、規制(zhi)(zhi)、管(guan)理、標準等制(zhi)(zhi)度(du)型開(kai)放。健全(quan)(quan)(quan)外(wai)(wai)商(shang)(shang)投資國家(jia)安全(quan)(quan)(quan)審查、反壟(long)斷審查、國家(jia)技術安全(quan)(quan)(quan)清(qing)(qing)單(dan)管(guan)理、不(bu)可(ke)靠實(shi)體(ti)清(qing)(qing)單(dan)等制(zhi)(zhi)度(du)。健全(quan)(quan)(quan)促(cu)進(jin)(jin)(jin)對外(wai)(wai)投資政策和服(fu)務(wu)體(ti)系。全(quan)(quan)(quan)面(mian)實(shi)施外(wai)(wai)商(shang)(shang)投資法及其實(shi)施條例,促(cu)進(jin)(jin)(jin)內外(wai)(wai)資企(qi)業公平(ping)競爭(zheng),建立健全(quan)(quan)(quan)外(wai)(wai)資企(qi)業投訴工作(zuo)機制(zhi)(zhi),保護外(wai)(wai)資合法權益。創新對外(wai)(wai)投資方(fang)式,提升(sheng)對外(wai)(wai)投資質量。推(tui)進(jin)(jin)(jin)國際產(chan)能合作(zuo),積極(ji)開(kai)展第三方(fang)市(shi)場合作(zuo)。

(四)積(ji)(ji)極參與(yu)(yu)全(quan)球(qiu)(qiu)經(jing)(jing)濟(ji)(ji)治(zhi)(zhi)理(li)體(ti)(ti)系(xi)變革(ge)(ge)。維護(hu)完善多邊(bian)貿(mao)(mao)易(yi)(yi)體(ti)(ti)制,維護(hu)世(shi)(shi)界(jie)貿(mao)(mao)易(yi)(yi)組(zu)(zu)(zu)織在多邊(bian)貿(mao)(mao)易(yi)(yi)體(ti)(ti)制中的(de)核心地位,積(ji)(ji)極推(tui)動(dong)和(he)(he)參與(yu)(yu)世(shi)(shi)界(jie)貿(mao)(mao)易(yi)(yi)組(zu)(zu)(zu)織改革(ge)(ge),積(ji)(ji)極參與(yu)(yu)多邊(bian)貿(mao)(mao)易(yi)(yi)規(gui)(gui)則(ze)談判,推(tui)動(dong)貿(mao)(mao)易(yi)(yi)和(he)(he)投資自(zi)由化便利化,推(tui)動(dong)構(gou)建(jian)(jian)更高水平的(de)國(guo)(guo)(guo)際(ji)經(jing)(jing)貿(mao)(mao)規(gui)(gui)則(ze)。加快自(zi)由貿(mao)(mao)易(yi)(yi)區(qu)建(jian)(jian)設,推(tui)動(dong)構(gou)建(jian)(jian)面(mian)向全(quan)球(qiu)(qiu)的(de)高標準(zhun)(zhun)自(zi)由貿(mao)(mao)易(yi)(yi)區(qu)網絡。依(yi)托共(gong)(gong)建(jian)(jian)“一(yi)帶一(yi)路”倡議及(ji)聯(lian)合國(guo)(guo)(guo)、上海合作組(zu)(zu)(zu)織、金磚國(guo)(guo)(guo)家(jia)、二十國(guo)(guo)(guo)集團(tuan)、亞太經(jing)(jing)合組(zu)(zu)(zu)織等多邊(bian)和(he)(he)區(qu)域(yu)次區(qu)域(yu)合作機制,積(ji)(ji)極參與(yu)(yu)全(quan)球(qiu)(qiu)經(jing)(jing)濟(ji)(ji)治(zhi)(zhi)理(li)和(he)(he)公共(gong)(gong)產品供給,構(gou)建(jian)(jian)全(quan)球(qiu)(qiu)互聯(lian)互通伙伴關(guan)系(xi),加強與(yu)(yu)相關(guan)國(guo)(guo)(guo)家(jia)、國(guo)(guo)(guo)際(ji)組(zu)(zu)(zu)織的(de)經(jing)(jing)濟(ji)(ji)發(fa)展倡議、規(gui)(gui)劃和(he)(he)標準(zhun)(zhun)的(de)對接。推(tui)動(dong)國(guo)(guo)(guo)際(ji)貨幣基金組(zu)(zu)(zu)織份額與(yu)(yu)治(zhi)(zhi)理(li)改革(ge)(ge)以(yi)及(ji)世(shi)(shi)界(jie)銀行投票權改革(ge)(ge)。積(ji)(ji)極參與(yu)(yu)國(guo)(guo)(guo)際(ji)宏(hong)觀經(jing)(jing)濟(ji)(ji)政策溝通協調及(ji)國(guo)(guo)(guo)際(ji)經(jing)(jing)濟(ji)(ji)治(zhi)(zhi)理(li)體(ti)(ti)系(xi)改革(ge)(ge)和(he)(he)建(jian)(jian)設,提(ti)出(chu)更多中國(guo)(guo)(guo)倡議、中國(guo)(guo)(guo)方案。

 

八、完(wan)善社會(hui)主義市(shi)場經濟法律制度(du),強(qiang)化法治保障

以保(bao)護(hu)產權、維護(hu)契約(yue)、統(tong)一市(shi)場(chang)、平等交換、公平競爭、有(you)效監管為(wei)基(ji)本導向,不(bu)斷完(wan)善社會(hui)主義市(shi)場(chang)經濟法治體(ti)系,確保(bao)有(you)法可依、有(you)法必(bi)依、違法必(bi)究。

(一)完善(shan)經(jing)濟(ji)(ji)領域法(fa)律(lv)法(fa)規(gui)體系。完善(shan)物權(quan)(quan)(quan)(quan)、債權(quan)(quan)(quan)(quan)、股權(quan)(quan)(quan)(quan)等各類(lei)產權(quan)(quan)(quan)(quan)相(xiang)關法(fa)律(lv)制(zhi)(zhi)度,從立法(fa)上(shang)賦予(yu)私有財產和(he)公有財產平(ping)等地(di)位并平(ping)等保(bao)護。健(jian)全(quan)破(po)產制(zhi)(zhi)度,改(gai)(gai)革完善(shan)企業(ye)破(po)產法(fa)律(lv)制(zhi)(zhi)度,推(tui)動個人(ren)破(po)產立法(fa),建(jian)立健(jian)全(quan)金(jin)融(rong)機構(gou)市場(chang)化退出法(fa)規(gui),實現(xian)市場(chang)主(zhu)體有序退出。修(xiu)訂反壟斷(duan)法(fa),推(tui)動社會信用(yong)法(fa)律(lv)建(jian)設,維護公平(ping)競爭市場(chang)環境(jing)(jing)。制(zhi)(zhi)定和(he)完善(shan)發展規(gui)劃、國(guo)土空間規(gui)劃、自然資(zi)源資(zi)產、生態環境(jing)(jing)、農業(ye)、財政稅收、金(jin)融(rong)、涉外經(jing)貿等方面法(fa)律(lv)法(fa)規(gui)。按(an)照包容審慎原則推(tui)進新經(jing)濟(ji)(ji)領域立法(fa)。健(jian)全(quan)重(zhong)大(da)改(gai)(gai)革特別(bie)授權(quan)(quan)(quan)(quan)機制(zhi)(zhi),對(dui)涉及調(diao)整現(xian)行(xing)法(fa)律(lv)法(fa)規(gui)的重(zhong)大(da)改(gai)(gai)革,按(an)法(fa)定程序經(jing)全(quan)國(guo)人(ren)大(da)或國(guo)務院統一授權(quan)(quan)(quan)(quan)后(hou),由有條(tiao)件的地(di)方先行(xing)開(kai)展改(gai)(gai)革試驗和(he)實踐創新。

(二)健全執法司法對(dui)市(shi)場(chang)經(jing)濟運行(xing)的保障(zhang)機制(zhi)。深化行(xing)政(zheng)執法體制(zhi)改革,最大限(xian)度減少不(bu)必要的行(xing)政(zheng)執法事項(xiang),規范行(xing)政(zheng)執法行(xing)為(wei),進一步明確具體操作(zuo)流程。根據不(bu)同(tong)層級政(zheng)府的事權和(he)職能,優化配(pei)置執法力量,加快推進綜合執法。強化對(dui)市(shi)場(chang)主(zhu)體之間產(chan)權糾紛的公(gong)平裁判(pan),完善(shan)涉及查封、扣押、凍結和(he)處置公(gong)民財產(chan)行(xing)為(wei)的法律制(zhi)度。健全涉產(chan)權冤錯案件有效防范和(he)常態化糾正機制(zhi)。

(三)全(quan)面(mian)建(jian)立行(xing)政(zheng)(zheng)(zheng)權(quan)(quan)力(li)制(zhi)約和(he)(he)監(jian)(jian)督機制(zhi)。依法全(quan)面(mian)履(lv)行(xing)政(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)能,推(tui)進(jin)機構、職(zhi)(zhi)能、權(quan)(quan)限(xian)、程(cheng)序、責(ze)任(ren)法定化,實(shi)(shi)行(xing)政(zheng)(zheng)(zheng)府(fu)(fu)權(quan)(quan)責(ze)清(qing)單制(zhi)度(du)。健(jian)全(quan)重(zhong)大(da)行(xing)政(zheng)(zheng)(zheng)決策程(cheng)序制(zhi)度(du),提高決策質量和(he)(he)效率。加強對政(zheng)(zheng)(zheng)府(fu)(fu)內(nei)部權(quan)(quan)力(li)的制(zhi)約,強化內(nei)部流程(cheng)控(kong)制(zhi),防止權(quan)(quan)力(li)濫用。完善審(shen)計(ji)制(zhi)度(du),對公共(gong)資(zi)金(jin)(jin)、國有資(zi)產、國有資(zi)源(yuan)和(he)(he)領(ling)(ling)導干部履(lv)行(xing)經濟責(ze)任(ren)情況實(shi)(shi)行(xing)審(shen)計(ji)全(quan)覆(fu)蓋。加強重(zhong)大(da)政(zheng)(zheng)(zheng)策、重(zhong)大(da)項(xiang)目(mu)財(cai)政(zheng)(zheng)(zheng)承受能力(li)評估。推(tui)動(dong)審(shen)批監(jian)(jian)管(guan)、執法司法、工程(cheng)建(jian)設、資(zi)源(yuan)開(kai)發、海外投資(zi)和(he)(he)在境外國有資(zi)產監(jian)(jian)管(guan)、金(jin)(jin)融信貸、公共(gong)資(zi)源(yuan)交易、公共(gong)財(cai)政(zheng)(zheng)(zheng)支出等重(zhong)點(dian)領(ling)(ling)域監(jian)(jian)督機制(zhi)改革(ge)和(he)(he)制(zhi)度(du)建(jian)設。依法推(tui)進(jin)財(cai)政(zheng)(zheng)(zheng)預算、公共(gong)資(zi)源(yuan)配置、重(zhong)大(da)建(jian)設項(xiang)目(mu)批準(zhun)和(he)(he)實(shi)(shi)施、社會公益事業建(jian)設等領(ling)(ling)域政(zheng)(zheng)(zheng)府(fu)(fu)信息公開(kai)。

(四)完善(shan)發(fa)(fa)展市場(chang)經(jing)濟監(jian)(jian)(jian)(jian)督(du)(du)制度和監(jian)(jian)(jian)(jian)督(du)(du)機制。堅持和完善(shan)黨(dang)(dang)和國家(jia)監(jian)(jian)(jian)(jian)督(du)(du)體系(xi),強(qiang)化政(zheng)(zheng)治監(jian)(jian)(jian)(jian)督(du)(du),嚴格(ge)約束公權(quan)力,推動(dong)落實(shi)黨(dang)(dang)委(黨(dang)(dang)組)主體責(ze)任(ren)、書記第一責(ze)任(ren)人責(ze)任(ren)、紀(ji)委監(jian)(jian)(jian)(jian)委監(jian)(jian)(jian)(jian)督(du)(du)責(ze)任(ren)。持之(zhi)以恒深入推進黨(dang)(dang)風廉(lian)政(zheng)(zheng)建設(she)和反腐敗斗爭,堅決依規(gui)依紀(ji)依法(fa)(fa)查處資源、土地(di)、規(gui)劃、建設(she)、工程、金融等領域腐敗問題。完善(shan)監(jian)(jian)(jian)(jian)察(cha)法(fa)(fa)實(shi)施制度體系(xi),圍繞權(quan)力運(yun)行各個環(huan)節(jie),壓減權(quan)力設(she)租尋租空間,堅決破除權(quan)錢交易關系(xi)網,實(shi)現執規(gui)執紀(ji)執法(fa)(fa)貫通,促進黨(dang)(dang)內監(jian)(jian)(jian)(jian)督(du)(du)、監(jian)(jian)(jian)(jian)察(cha)監(jian)(jian)(jian)(jian)督(du)(du)、行政(zheng)(zheng)監(jian)(jian)(jian)(jian)督(du)(du)、司法(fa)(fa)監(jian)(jian)(jian)(jian)督(du)(du)、審計(ji)監(jian)(jian)(jian)(jian)督(du)(du)、財會(hui)監(jian)(jian)(jian)(jian)督(du)(du)、統計(ji)監(jian)(jian)(jian)(jian)督(du)(du)、群眾監(jian)(jian)(jian)(jian)督(du)(du)、輿論監(jian)(jian)(jian)(jian)督(du)(du)協同發(fa)(fa)力,推動(dong)社會(hui)主義(yi)市場(chang)經(jing)濟健康發(fa)(fa)展。

 

九、堅持和加(jia)強黨的全(quan)面領導,確(que)保改革舉措有效實施

發揮黨總攬(lan)全(quan)局(ju)、協調(diao)各方的(de)領導核心作用,把黨領導經(jing)濟工作的(de)制度(du)優勢轉化為(wei)治理效能,強化改(gai)革落地見效,推動(dong)經(jing)濟體制改(gai)革不斷(duan)走深走實。

(一(yi)(yi))堅持和加強(qiang)黨(dang)的領導。進(jin)一(yi)(yi)步(bu)增(zeng)強(qiang)“四(si)個意(yi)識(shi)”、堅定(ding)“四(si)個自(zi)信(xin)”、做到“兩個維(wei)護(hu)”,從(cong)戰略和全局高度深(shen)刻認識(shi)加快完善(shan)社(she)(she)會(hui)(hui)主義(yi)市(shi)場(chang)經濟體制(zhi)的重大意(yi)義(yi),把(ba)黨(dang)的領導貫(guan)穿于(yu)深(shen)化經濟體制(zhi)改(gai)(gai)(gai)革(ge)和加快完善(shan)社(she)(she)會(hui)(hui)主義(yi)市(shi)場(chang)經濟體制(zhi)全過程,貫(guan)穿于(yu)謀劃改(gai)(gai)(gai)革(ge)思路、制(zhi)定(ding)改(gai)(gai)(gai)革(ge)方案、推(tui)進(jin)改(gai)(gai)(gai)革(ge)實施(shi)等各(ge)環節,確保改(gai)(gai)(gai)革(ge)始終沿(yan)著正確方向前(qian)進(jin)。

(二(er))健(jian)全改革推進機制(zhi)。各(ge)地(di)區(qu)各(ge)部門(men)要(yao)(yao)按照本意見要(yao)(yao)求并(bing)結合自身實(shi)(shi)際(ji),制(zhi)定完善配套(tao)政策或實(shi)(shi)施措施。從(cong)國情出發,堅持問題導(dao)(dao)向(xiang)、目(mu)標導(dao)(dao)向(xiang)和(he)結果導(dao)(dao)向(xiang)相(xiang)統(tong)一,按照系統(tong)集成、協(xie)同(tong)高效要(yao)(yao)求縱深推進,在精(jing)準實(shi)(shi)施、精(jing)準落實(shi)(shi)上下足功夫,把落實(shi)(shi)黨中(zhong)央要(yao)(yao)求、滿足實(shi)(shi)踐需要(yao)(yao)、符合基層期盼統(tong)一起(qi)來(lai),克服形(xing)式主義、官僚主義,一個領域一個領域盯住抓落實(shi)(shi)。將頂(ding)層設計與基層探(tan)索結合起(qi)來(lai),充分(fen)發揮基層首創(chuang)精(jing)神,發揮經濟特區(qu)、自由貿(mao)易試驗(yan)區(qu)(自由貿(mao)易港(gang))的先行先試作用(yong)。

(三)完善改(gai)(gai)(gai)革激勵機制(zhi)。健全(quan)改(gai)(gai)(gai)革的(de)(de)正向激勵體系,強化(hua)敢于(yu)擔當、攻堅(jian)克難的(de)(de)用(yong)人導向,注重(zhong)在改(gai)(gai)(gai)革一線考察(cha)識(shi)別干(gan)部,把(ba)那些具有(you)改(gai)(gai)(gai)革創新(xin)意識(shi)、勇(yong)于(yu)改(gai)(gai)(gai)革、善謀改(gai)(gai)(gai)革的(de)(de)干(gan)部用(yong)起來(lai)。鞏固(gu)黨(dang)風廉(lian)政(zheng)建(jian)設成(cheng)果,推動構建(jian)親清政(zheng)商關系。建(jian)立健全(quan)改(gai)(gai)(gai)革容錯糾錯機制(zhi),正確把(ba)握(wo)干(gan)部在改(gai)(gai)(gai)革創新(xin)中出現失誤(wu)錯誤(wu)的(de)(de)性質和影響(xiang),切實保護干(gan)部干(gan)事創業的(de)(de)積(ji)極性。加強對改(gai)(gai)(gai)革典型案(an)例(li)、改(gai)(gai)(gai)革成(cheng)效(xiao)的(de)(de)總(zong)結推廣(guang)和宣傳報道(dao),按規定(ding)給予表彰激勵,為改(gai)(gai)(gai)革營造良好輿(yu)論環(huan)境和社會氛圍(wei)。
